CRITERIA FOR ADMISSION

The Shillong Law College is imparting the Three-year LL.B (Pass) Degree Course (Semester System). The application form will be issued to the applicants who secured the required percentage of marks in graduation, as fixed by the Bar Council of India and approved by the North Eastern Hill University, Shillong. The minimum qualification required for admission is a Bachelor Degree in any discipline from a recognized University in the country with 45% marks of the maximum marks in case of general category applicants and 40% in case of SC/ST and OBC applicants.

COURSE OF STUDY FOR THE LL.B (PASS) DEGREE COURSE

The Three-year LL.B (Pass) Degree Course comprises of 30 papers, spread over six semesters. Each semester consists of five papers. The whole course contains twenty compulsory papers, four clinical papers and six optional papers.

Each course except the two clinical courses i.e., (i) Drafting, Pleading & Conveyancing, and (ii) Moot Court Exercise and Internship, has been divided into four units with 30 to 35 class lectures per course and the pattern of evaluation will be setting of two questions from each unit in the End Semester Examination. Servicing of the two clinical courses is explained in page 4 of the Prospectus.

The Compulsory Law papers, optional papers and two clinical paper viz., (i) Professional Ethics & Professional Accounting System and (ii) Alternate Dispute Resolution in Semester III & IV respectively, shall be of 100 marks each containing eight questions and every examination shall be of three hour duration at the end of each Semester.

THE TWO CLINICAL COURSES WILL BE EVALUATED AS FOLLOWS:-

1. Drafting, Pleading and Conveyancing - The Course will be taught through class room instructions and simulation exercises in V-Semesters preferably with the assistance of Practising Lawyers/Retired Judges. Apart from teaching the relevant provisions of Law, the course may include not less than 15 practical exercises in drafting, carrying a total of 45 marks (3 marks for each) and 15 exercises in conveyancing, carrying another 45 marks (3 marks for each exercise) and the remaining 10 marks will be given for viva voce.
2. Moot Court Exercise and Internship - This paper will be taught in VI Semester and has 3 components of 30 marks each and a viva vice for 10 marks as follows:-
   1. Moot Court (30 marks) - Every student shall be required to do atleast 3 moot courts in a year with 10 marks each. The Moot Court will be on assigned problem and it will be evaluated for 10 marks for written submission and 5 marks for oral advocacy.
   2. Observation of Trial in two Cases, One Civil and one Criminal (30 marks) - Students may be required to attend two trials in the course of the last three years of LL.B studies. They will maintain a record and enter the various steps observed by them during their attendance on different days in the court. This scheme will carry 30 marks.
   3. Interview Techniques and Pre-trial preparations. (30 marks) - Each student will observe two interviewing sessions of clients at the lawyer's office/Legal Aid Office and record the proceeding in a diary, which will carry 15 marks. Each student will further observe the preparation of documents and Court papers and the procedure for the filing of the suit/petition. This will be recorded in the diary, which will carry 15 marks.
   4. The fourth component of this paper will be the Viva Voce Examination of all the above three aspects. This will carry 10 marks.

INTERNSHIP

Each registered student shall have to complete twelve weeks of internship during the entire period of legal studies for three year unitary course and in any year it cannot be for a continuous period of more than four weeks.

ADMISSION PROCEDURE

Application for admission into the 3 year LL.B (Semester System) in prescribed form will be accepted as per the Notice issued by the College.

Each application must be accompanied by Xeroxed attested copies of the following documents:

1. Degree Certificate/Provisional Certificate of the University or College.
2. Admit Card and Mark Sheet of the degree examination passed.
3. SC/ST/OBC certificate issued by competent Authority.
4. Birth Certificate/Matriculation Admit Card with proof of age.
5. Migration Certificate.(If available)
6. A recent passport size photograph.

Application form not accompanied by the required documents and not fulfilling the criteria for admission will be treated as incomplete and will be summarily rejected.

After submission of the application form, candidates are required to be present personally and to produce the original certificates for verification. When admission is granted, the fees must be paid and the necessary formalities must be completed within 24 hours, otherwise the admission will stand cancelled. An applicant who fails to appear on the date and time notifies by the college, will summarily be refused admission. The College reserves the right to refuse an application for admission into LL.B without assigning any reason for the same.

REGISTRATION

After admission, students who migrated from other Universities other than the North Eastern Hill University shall have to register themselves with the North Eastern Hill University. They must apply for registration in the prescribed proforma of the University and also submit Original Migration Certificate along with the application to NEHU.

REGULATIONS ON FIVE YEAR B.A.LL.B INTEGRATED (HONOURS) DEGREE COURSE

1. Duration and Structure
1. The BA.LL.B Integrated (Honours) Degree Course under the Rules and Guidelines of the University (NEHU) shall be a full time Course ordinarily spread over a period of five academic years.
2. The Course shall be conducted in Semester system in not less than 18 weeks in a semester and not less than 36 class hours per-week including Tutorial, Moot Court room exercises and Seminars with at least 30 lecture hour per week.
3. (c) The Course structure and distribution of credit/marks shall be such as prescribed in the syllabus prepared in accordance with the guidelines of BCI and UGC and dully approved by the Academic Council of the University from time to time.
   
2. Eligibility for Admission
1. An applicant who successfully completed Higher/Senior Secondary School Course (10+2) or equivalent (such as 11+1, A level in Senior School Leaving Certificate Course) from a recognized university of India or outside or from a Senior Secondary Board or equivalent examination in any stream securing an aggregate of not less than 50% of the total marks, relaxable by 5% for SC and ST shall be eligible to seek admission to the programme.
2. The maximum age for seeking admission into the Course is limited to 20 (twenty) years in case of general category of applicants and to 22 (twenty two) years in case of applicants from SC/ST and other Backward Communities.
3. No student shall be allowed to simultaneously register for the Course with any other graduate/Post Graduate/certificate course(s) run by the University or any other University/Institute for academic of professional learning. Provided that any short period part time certificate course on language, computer science or computer application of an institute of any course run by a centre for Distance Learning of a University however, shall be exempted.
   
3. Admission
1. The course shall have 60 seats.
2. Admission to the Course shall be made only in the First Semester on the basis of the candidate’s performance in the written test to be conducted by the College for the purpose. A merit list shall be prepared taken into consideration the candidate’s performance in the above mentioned test and admission shall be made on the basis of the merit list in accordance with personally interview and to produce the original certificates for verification. When admission is granted, the fees must be paid and the necessary formalities must be completed within 24 hours, otherwise the admission will stand cancelled. An applicant who fails to appear on the date and time notified by the college, will summarily be refused admission. The College reserves the right to refuse an application for admission into LL.B Course without assigning any reason.
3. The standard of the admission test shall be of class 12 (10+2) of the CBSE of its equivalent covering four broad areas viz., General English, General Knowledge, Logical Reasoning and Legal Aptitude. Other details of the Test may be such decided by the College from time to time.
4. Attendance
A student shall have to attend in each course a minimum of 75% of Lectures, Seminars, Tutorials, Moot Court room exercises and Practical Trainings conducted in the course taken together during a semester to be eligible to appear at the end semester Examination.
Provided that on exceptional cases for reasons to be recorded, the Principal may consider and decide on the request for condonation of shortage of attendance upto 10% in a course subject to a minimum of 70% attendance in all the courses taken together.
Provided further that a list of such student allowed to take the examinations with reason recorded be forwarded to the Bar Council of India.
5. Division and classes
In order to qualify for B.A.LL.B Integrated (Hons) degree a candidate shall have to obtain at least 40% marks in each paper of study and 50% marks in aggregate. A candidate securing 50% marks or more but less than 60% marks in aggregate shall be placed in the second (II) division and a candidate securing 60% marks or more in aggregate shall be in the First (I) Division. A candidate obtaining 75% marks or more in any particular paper shall be awarded distinction in that paper.
6. Eligibility for the Award of Degree
1. A candidate shall be eligible for the award of BA.LL.B Integrated (Honours) degree on the basis of his/her performance in the 10 (ten) End Semester Examinations and the sessionals.
2. A candidate shall be given a maximum of 2(two) chances appearing at the examination) to clear a paper.
3. A candidate shall have to clear all the prescribed paper within a maximum period of 7 years from the date of admission in order to obtain the B.A. LL.B Integrated (Hons) degree.
7. Improvement
A student obtaining 40% and above marks in any paper other than a clinical paper or project work may, if she/he so desires, to improve her/his performance in the paper may be allowed only once to appear at the end semester examination for that course subject to fulfilment of the provision under clause 6(b) of this regulation.

FIVE YEAR BA.LL.B INTEGRATED (HONOURS) DEGREE PROGRAMME.

Introduction:-

The Five Year BA.LL.B Integrated (Hons) Degree Programme comprises of fifty one (51) Course, spread over Ten (10) Semesters, Each Semester of the Programme consists of Five Courses except the Semester Ten (10) which has Six (6) Courses. This programme contains Eighteen (18) Compulsory Courses, Four (4) Clinical Courses, Six (6) Optional Courses, Eight (8) Honours Courses and Fifteen (15) Liberal Courses.
Each Course except Two (2) Clinical Courses i.e., Drafting, Pleading & Conveyance and Moot Court Exercise and Internship, have been divided into four units and the pattern of evaluation involves setting of two questions from each unit in the End Semester Examination.
As provided in the Regulation relating to the Five Year Integrated B.A. LLB (Hons) Degree Programme, the Compulsory Law Courses, Optional Courses, Honours Courses, Liberal Courses \, and Two (2) Clinical Courses i.e., Professional Ethics and Professional Accounting System and Alternative Dispute Resolution will be evaluated in the ratio of 40:60 i.e., 40% weightage is allotted for continuous sessional works and 60% weightage for the end Semester Examination. The other two Clinical Courses will be evaluated as follows:

1. Drafting, Pleading and Conveyance– The Course will be taught through class instruction and simulation exercises preferably with assistance of practicing Lawyers/Retired Judges.
   A part from teaching the relevant provisions of Law, the course may include not less than 15 practical exercises in drafting carrying a total of 45 marks (3 mark for each) and 15 exercises in conveyancing carrying another 45 marks (3 marks for each exercise) remaining 10 marks will be given for viva voce.

Each student will further observe the preparation of documents and Court papers by the advocate and the procedure for the filling of the suit/petition. This will be recorded in the diary, 3which will carry 15 marks.
4. The fourth component of this paper will be Viva Voce Examination of all the above three aspects. This will carry 10 marks.

Internship:
Each registered student shall have to complete twenty weeks of Internship during the entire period of legal studies of Five Year Course and in any year it cannot be for a continuous period of more than four weeks.
